Legal Question in Family Law in New York

separation after over 10 years

I have been separated from my wife for over 10 years. I want to know how this affect me legally. Is the marriage still legal of not. She left without any word and I don't know where she is at this time. How do I divorce her (if that's even neccessary). I don't know where she is.

You are still married. You are only divorced after a court grants a divorce. There are, however, methods of obtaining a divorce even if you do not know your wife's current whereabouts.

Re: separation after over 10 years

Sorry, but you are still married, no matter how long you have been separated.

If you are unable to locate your wife for the purpose of having her served with papers, then you may ask the court to permit you serve her by publication.
