Legal Question in Family Law in New York

I got served

my childs father served me with court orders over custody of our 6 year old daughter.He did this to keep me from moving in with my mother and step dad.My half sister also lives there.My basic question is if I have any rights to see her or speek to her on the phone? He has denied me these things and says I cannot see or talk to her until December 10,2007.What rights do I have as her mother?There was never any court ordered custody. Thankyou
