Legal Question in Family Law in New York

I was served with papers for a divorce and custody for our daughter. They have a court date. The courthouse is about six hours away. My daughter has been living with me. What procedure can I use to get the courthouse close to me to take the case?.

It's extremely unusual to be able to change venue of a matrimonial case; usually whoever files chooses the county in which the case is litigated. The only good news is that very few court appearances are required in a divorce case.

It's also extremely unusual to be served with divorce papers that have a court date - perhaps there are two sets of papers, one with a Family Court custody case, which would have a set hearing date, and one with a divorce, which would not...or perhaps there's an Order to Show Cause in the divorce with regard to temporary custody - which would also have a date set for hearing.

If you'd like to discuss the matter in confidence, please feel free to get in touch.
