what can i do about this legaly,being that it is his 3rd time and he is 14 years old?

We don't know what role you and he play in this illegal activity. This is a very serious matter. He and possibly you need to consult with an attorney ASAP. You could also contact the state attorney general's office. Failure to take action and for this to occur again may well make you also criminally liable.
