Legal Question in Family Law in New York

Sibling visitation rights

My 24 year old Foster son, whom I've had since he was 14, has three younger

sisters that his mother, who is completely out of her mind, will not allow him

to see. She is extremely religious, keeps the girls secluded at home all the

time and has denied Gary any access to them in the last few weeks. The

mother has also denied Gary's grandparents any access and we believe there

is sexual/physical abuse going on in the house with her new husband, this

would be husband number 4. Gary would like to sue for sibling visitation and

I would like to know how I can help him and how best to go about it. Thank

you

Re: Sibling visitation rights

This is an interesting legal question. Typically, visitation is for parents. Grandparents also have legal standing.

While there is no specific entitlement, public policy has determined that sibling contact is beneficial and it is possible to petition. I would bring a petition under the grandparent statute and cite the sibling contact caselaw.

It would be helpful to have an attorney for this action. You are welcome to a consultation for no fee.
