Legal Question in Family Law in New York

I signed a stipulation in Brooklyn Supreme Court in a contested divorce action which was to assign me a $25000 portion of my wifes retirement funds through a QDRO. This was signed 9/10/2009. As

of today 12/17/09 I have not received any further paperwork or information regarding this QDRO from either the court or the pension plan administrator. I would like to know if I am permitted to write the judge a letter requesting the status of this matter. This stipulation was issued to end the marriage

without any further claims made by either party.

Hello Howard,

If you were represented by an attorney during your action, they are the best one to ask about your QDRO. If you were not represented by counsel, then you should contact the individual plan administrator, as they may have not even necessarily received said QDRO after it was signed.

Yes, you can write to the judge, but doing so is unlikely to get you anywhere, as they are not responsible for the execution of the QDRO after it was signed.
