Legal Question in Family Law in New York

Name Signing

Hello. My husband and his ex-wife own a house together. The divorce papers state that she is responsible for the mortgage, etc. However, his name remains on the deed and the mortgage. The house is on the way to foreclosure but, that is another topic altogether. Without his permission, ex-wife signed his name on the listing contract. She is not Power of Attorney. Is this legal?

Of course not.

But since she is ruining your husband's credit and he is liable to the mortgage company, get the house sold ASAP!

The divorce papers may say she is responsible for the mortgage BUT the mortgage co won't see it that way.
