Legal Question in Family Law in New York

I am in a situation where the divorce agreement was signed, and now my ex doesn't want to follow it. He wants to change when the custody starts, and his lawyer didn't see that we have changed the plaintiff and the defendant. The judge hasn't signed off on it yet. His lawyer wants to take me back to court. Do I follow this agreement?
