Legal Question in Family Law in New York

sleeping arrangements

My boyfriend has visitation with his 2 year old daughter. He would like to have overnights, but his ex says no because the baby does not have her own bedroom. She has her own toddler bed in our bedroom, but we do not have another room. If they go to court, is there any law preventing him from having her overnight every other weekend?

Re: sleeping arrangements

If sleeping arrangements for your boyfriend's child are not acceptable to the Court, his request for overnight visitation CAN be denied.

Therefore, arrangements SHOULD be made for your boyfriend's daughter to have her own sleeping space, separate and apart from your and her father's sleeping space. (Perhaps, her bed can be moved to a space in the living room).

In the US, it is considered inappropriate for children to share a bedroom with adult partners (whether they are married or not).

Good luck,
