Legal Question in Family Law in New York
Social Security Number
I have filed an uncontested divorce. Defendant signed and notarized Affidavit of Waiver, but dose not want to submit social security number.
I have waited 40 days now from the date the waiver was signed and notirized by the defendant. I still have no social security number for the defendant.
All questions and forms are compleate, READY to go.
Can I still submit forms for an uncontested caladar date?

Re: Social Security Number
You can submit them. However, the court might bounce them back because the social security number is required. If the Defendant signed everything else, you might end up with a court date from the court to address the issue of the missing social security number. Advise the Defendant that his failure to provide that could result in the need for you or both of you to hire an attorney and go to court. That may motivate him to provide you with the necessary information. Did you ever file a joint tax return? If you did, ask the IRS for a copy of the return. Both social security numbers will be on the return. Think about any other documents you filed together that might contain that number. Also, if you pull a copy of your credit report, you might be surprised to find that your spouse is listed on that report, with the social security number you are looking for. You can submit the papers, but odds are they will be returned to you because of the missing social security number. You may have to take him to court to force him to reveal the social security number.
