I want to keep sole custody!
My daughter is 4 years old and presently in my custody. Her father is not a good influence but he still wants to be in her life. I am not keeping her from him by any means, but I am limiting the time he has with her. The home he lives in is full of smokers and they have no regard for her well being. She is not supervised on a regular basis, and is never disciplined while there. This makes it hard when she comes home and transitions from her father's home to mine. He has a sketchy past with drug use and not maintaing a job. He also has a real problem with authority. I would just like to know what I can do because he is now threatening to take me back to court and get joint custody. I only want what is best for my daughter and I do not believe that her father is the best influence.

In NY the courts try to foster a relationship with both parents when children are the subject. So despite the fact that he may not be the most responsble parent, his visitation may not be completely suspended by the courts and granted joint custody unless doing so is not in the best interest of the child.
