Legal Question in Family Law in New York

My son was born in NYC 3.5 years ago. When my son son Ywas conceived I was separated from my husband(who is not the father). The father of my decided he didn't want to be involved. I convinced him to sign the birth certificate so I can put my son on his insurance, but that only lasted a couple of months. The last time his father saw him was when he was 2 months old. He has no legal rights nor has paid any child support or has made any attempts to see him. My question is is my sons birth certificate legal since I was married to someone else at the time could his birth certificate be void? And his father be taken off?

Whoever signed the birth certificate is presumed to be the father

Ordinarily your husband is presumed to be the father
