Legal Question in Family Law in New York

Son's Father Engaged

Single mom, 5y/o son, amicable relationship with birth father. He's

moved on and has a girl (+ new baby) and he just told me last

night they got engaged. His financial contribution toward my son

is embarrassing but I've never filed for child support out of fear

(domestic violence history with us). I now have someone new too.

If he gets married, am I at risk for him legally EASILY gaining

custody over our son because he's married and I'm not? My son

has lived with me all his life, has met his dad's baby (his half

brother). Would a judge consider his 'married with 2 kids' living

arrangement over mine (me, my son and live-in boyfriend living

arrangement?

Do not worry. Even the worst judges look beyond living arrangments . The teSt for cutody is the Best Interest of the Child and that is far more than whether the mom or dad is married.
