Legal Question in Family Law in New York

my sons wife abandoned him and their 3 disabled children. she is out of state with another man. he filed for full custody of the children. if she returns home, does he have to let her stay in the home? he lives in new york state. also, the disability checks are in his wifes name and the childrens. can he have his name put on the checks and hers removed before the custody hearing?

He needs to seek counsel to file for divorce and obtain full custody. Counsel will advise him on filing for divorce, having her removed from the home, and changing the names on the check to the custodial guardian.
