Legal Question in Family Law in New York

Splitting assets prior to divorce?

Hello I married my wife just under 2 years ago. no prenuptial agreement as we didn't have much. During that time though i secured a job and managed to buy a home cash with her. Now i have decided i want out of the marriage as does she but she wants her half of the money back. how do I proceed? Is there a contract that should be made while we are married, should we involve attorneys? My biggest fear is I give her the money and later she decides to or is for some reason awarded half of whats mine. I want to leave and break this marriage off while still on good terms. We are not compatible and thats why im doing this. I still feel though she is more emotionally attached than I am and would possibly do things to hold onto me or to get back at me. Furthermore i want to leave while preserving both of our integrity and i want to move on with my life. Thankfully since we have remained faithful and have given it our best shot im hoping this is the only obstical. Any suggestions on how to proceed about giving her her half and parting ways?

Re: Splitting assets prior to divorce?

I think you should informally discuss the divorce and how assets (and liabilities) are divided. If there is an agreement, you can contact an attorney to draft the agreement and formalize the divorce. However, that attorney can only represent 1 individual.

If you want you can give me a call and I will help you out.

Mike.
