Legal Question in Family Law in New York

Spousal Removal from Home

My home is in my sole name, my spouse has filed a petition of divorce against me which was served a few days ago. I have custody of both my home, and children at this time, (without Court Order)however, my spouse has removed my childrens clothing, kitchen utensils, family photographs of the children, and other property. My question is, undert what circumstances can I prevent my spouse from re-entering the home without my permission, or. does the fact she has removed her clothing from my home give me reason to assume she has voluntarily left the home..??

Re: Spousal Removal from Home

Your situation is already complicated and any number of factors bear on what you should be doing to protect what you have in your home and your children. Sorry to sound so lawyerly and unhelpful, but you really need to consult with an attorney who can properly advise you based on adequate information as soon as possible.
