Legal Question in Family Law in New York
My spouse and I are getting a divorce. We have agreed on the disposition of our assets and are prepared to sign a Stipulation of Settlement. However, we each owned a piece of real estate prior to our marriage and then purchased one together once were married. Personally, although I am happy we were able to agree on the disposition of them all, I worry that if I don't mention that my piece of real estate will be solely mine after the divorce that my spouse may try to take advantage of its lack of mention in the Stipulation.
What I was wondering is: does a Stipulation of Settlement HAVE to or SHOULD it include details about the disposition of all three pieces of real estate?

The best advice I can give is that if your truly worried about your rights and obligations, you should retain a competent attorney to draft the agreement.
