Legal Question in Family Law in New York

My spouse was served and the 40 day period has passed without her returning the signed papers. The court is requesting the Affidavit of Defendant and the Separate and Apart Agreement. How can I keep this moving forward if she never returned them to me.

You would have to make application for default Judgment of Divorce.
