What if my spouse refuses to sign the papers he or she is served with?

Spouse's refusal to sign divorce papers

You can still get your divorce without your spouse's cooperation, but you will have to wait at least 40 days from the date he or she was properly served with divorce papers. After that time, your spouse is in default and you may proceed to file final papers.
