Legal Question in Family Law in New York

Starting a Will

I'm interested in know what one need to do to have a will. Does one just fill out the information on the proper form and put it in a safe or does it need to be registered somewhere. I'm looking to simply leave all to my wife in case of my death and in case of our death leave everything to my 3 children and their custody would then go to my sister-in-law. Please let me know your thoughts

Re: Starting a Will

A Will must be written carefully, in a proper format. Then it must be executed in front of two witnesses. It is best to also have an attorney write and oversee the execution. When an attorney does the execution properly, the Will is presumed valid. Having an attorney write the Will is not usually expensive and is well worth the extra cost. Most will also store the Will for you without charge. That is preferable to storing it in a safe deposit box or other place where it can be altered or destroyed. Only the original Will is admissable to probate - so use care! Good luck.
