Legal Question in Family Law in New York

Out of State Trip

I live in New York, and my daughter's father says that he is not letting me take our daughter to Florida for 5 days. We are not married, but i live with him. What can I do to legally take my daughter on the trip What steps can i take? Can he claim that I kidnapped her?

As long as neither of you has sole custody (you live together so it is doubtful)it is not kidnapping for you (or him) to take your daughter out of the state.

I suggest you just take her.
