Legal Question in Family Law in New York

Out of State Trip

I live in New York, and my daughter's father says that he is not letting me take our daughter to Florida for 5 days. We are not married, but i live with him. What can I do to legally take my daughter on the trip What steps can i take? Can he claim that I kidnapped her?

Since the two of you live together, technically neither of you have "legal" custody. If you are only going for a short period, you are committing any laws, as long as there is no court orders prohibiting travelling out of state.
