In the State of New York, are personal bank accounts counted as marital property and can be divided in the divorce?
If so, if I create a joint account our child or someone else that not my spouse and move money from my personal account over, is the spouse able to retrieve the money in the divorce?

Yes, under almost all circumstances they are marital property.
