Legal Question in Family Law in New York

Status in USA of unconsummated marriage in foreign country

I am a US citizen. I married a man in Karachi, Pakistan some three months back, according to the Muslim rite. The marriage was unconsummated, having taken place on the day of my departure. I wish to get out of this marriage now. What is the status of such a marriage in the US?

Re: Status in USA of unconsummated marriage in foreign country

NY will recognize a foreign marriage, so long as the marriage is valid under the laws of the foreign jurisdiction. Therefore, under NY law, you are legally married.

Of course, you may seek an annulment or divorce under NY law, if you are so inclined. You do not mention how long you were in Pakistan, but you may first have to establish jurisdiction in NY.

Suggest you consult with an experienced matrimonial attorney.
