Legal Question in Family Law in New York

Trying to stay in my sons life

I was married for 8 years my wife left my son and I.

I filled for custody her jod help her fill for devorced and custody.

the courts did listen to any of my evidence and I felt forced into joint custody.

Now my exwife is going to marry the man she abanded her family to and is going to take me back to court for full custody.

I was also told that The Department of corrections was being sued for families affected by there job I was woundering if this is true

Your ex-wife does not have an advantage in regaining custody. the courts want to see 'continuity' in the child's life.

That means that the courts will favor you continuing custody because that is the life your child has adjusted to.

Get yourself a good lawyer, one with whom you are comfortable and do not worry about the corrections department. They are not a party to any action and will play no role in your custody action. they will not pay for your ex's lawyer, nor will they appear in court, nor will any evidence of them be permitted in your case. they are a 'shadow-tiger', intimidating, but can take no action.
