Step parent adoption
I am writing with a quick question in regards to the procedure for my husband to adopt my 3 1/2 year old daughter. I do not know who her biological father is due to stupidity on my part 3 1/2 years ago. It was unfortunatly a one night stand with someone i have no idea who it is. My life is very complete and happy now with my husband, his two children and my daughter. We would like my daughter to be adopted by my husband. Because I do not know who her dad is I am the only one of the birth certificate. He has been in our life since she was 1 year old and he is her ''daddy''. What do i need to do for her to have his last name and be her dad? Thanks

Both your county Supreme and Family Court have jurisdiction over private adoptions. First go to speak with the adoption clerk. If you feel the procedures are too complicated your local bar association can refer you to an attorney familiar with this area of law. If the matter was in South Florida I could help you. You and your husband need to file an adoption petition [even though you are the biological parent]. You will have to submit an affidavit to the court stating that you do not know the name of the biological father.
