Legal Question in Family Law in New York
Stepchild adoption
I was granted sole custody of my child through court two years ago and am going to marry my boyfriend this summer. He is interested in adopting my son after we get married and I would like to know if we still need his biological fathers consent even if I was granted sole custody in the past. Hope someone can give me some information. Thanks.

Re: Stepchild adoption
Hi,
I am an adoption attorney in new york. The birth father's consent is required for an adoption of your child by your new husband. Another option is a termination of his parental rights, if there are grounds to do so. I would be happy to speak to you about the details of your situation to give you a better answer about what your options are. I do not charge for an initial consultation. Please contact me by email.
Very truly yours,
