Stepchild adoption

I was granted sole custody of my child through court two years ago and am going to marry my boyfriend this summer. He is interested in adopting my son after we get married and I would like to know if we still need his biological fathers consent even if I was granted sole custody in the past. Hope someone can give me some information. Thanks.

Hi,

I am an adoption attorney in new york. The birth father's consent is required for an adoption of your child by your new husband. Another option is a termination of his parental rights, if there are grounds to do so.
