Legal Question in Family Law in New York

Step-parent Liabilities for non-custodial child

After searching the web for NY Statutes, to no avail, I am questioning here for an answer. I am married to a father who has not seen his child from a previous marriage in several years and has an existing child support order. He is unemployed now and my question is whether or not the responsibility of paying the support can be put on me. I have seen writings that step-parents are liable in some states, but it's not clear if that is only when they have custody or take part in the upbringing of the child. We do not see this child and it looks like we may never see it.

Re: Step-parent Liabilities for non-custodial child

You are not truly a "stepparent". You have no exposure to liability for child support for the child that is not yours.

In NY, you would not be liable for the support of another's child whom you have no history or relationship with. Feel free to call me at 212-367-9167. I do not charge a fee for the initial consultation.
