When do we stop paying cjild support.

When should we stop paying child support? My husband has three kids. The first is 22 and has an apartment and a job. The second is in college, has her own apartment and a fulltime job. The youngest turned 18 last week, is not in scholl at all, has no job, has a three month old baby and still lives at home most of the time. Should we still have to pay for them if they can support themselves or in the case of the youngest one, has a child of her own?

The question of when to stop paying child support is usually controlled by one, if not both, of two documents.

1. New York Law - the default age at which to stop paying is age 21.

2. The ruling or settlement in your divorce - which controls over the default if it specifies. Often my clients' settlement agreements specify what will terminate the obligation to pay child support. It may be the emancipation of the child, by virtue of his or her accepting full time employment after the age of 18. It may be graduation from college, with support payments continued if the child is enrolled as a full time student up to a certain age (often 22).

You should check your divorce papers carefully, and if you can't determine, consult your attorney.
