Legal Question in Family Law in New York

'' stop the petition''

My sister is presently in a local nursing home. After learning that the family wants to arrange for alternative care, the nursing home has petitioned the court for guardianship. How can I stop this petition? My sister suffers from brain truama and has been under the care of this facility for a number of years. How much rights are afforded the family in this situation?

No need to stop the petition.

Rather than stop the petition you should get counsel and have a family member appointed as guardian. If your sister is in poor medical condition it limits the amount she can do and a guardian may be helpful. The guardian can also easily order the removal of your sister from the home to assisted living.

Please contact a competant attorney immediately as these petitions tend to move quickly through the court.
