Stoping my child support
Now that my 14 year old daughter is living with me in Florida, how can i have the court in New york stop taking child support from my payroll. Is there a form for me to complete or do i have to go back to New york to seek help from the court. My daughter has been living with me since July 9th,2005. She is enrolled in school and is doing much better in Florida. I have a letter from mom giving me permission to keep her due to the fact that she is now on public assisstant and cannot manage her with her other child that i am not the father for. Please email me the form to be completed at [email protected]. I cannot take too much time from my job being that i am only there for 7months, so please help me to resolve this the easiest way . You should file a petition to modify the order of support in the state where the order was issued (presumably, NY). It might be wise to file a correlating petition to modify the custody arrangement. Feel free to call my offcie if you have any questions. There is no fee for the initial consultation.

This is done on motion to the court and not by filling out a form.
The motion is made on notice and the remedy is 'modification of support'.
My fee for drafting the motion and the court appearence would be $500.00.

Family Court is a Pro Se Court. Which means you may with assistance from the Court file your own Petitions and Motions.
Go to the NY Unified Court Website to download template docs for support/custody modification petitions and call the Court Petition office directly for further info on how you may proceed given your out of state location.
