Legal Question in Family Law in New York
Stopping Child Support
My child support payments are automatically deducted from my Nassau County Compensation check. I hired a lawyer a few months ago to have my payments stopped since my daughter has turned 18 back in December. Unfortunately he has yet to file a motion he claims he needed to & isnt returning my calls. Is there a way I can represent myself & have my support stopped on my own without the help of an attorney? I have tried to contact the proper agency (SCU) both by phone & by mail but they have not responded. Are there certain procedures that have to be done in a court of law?

Re: Stopping Child Support
In NY child support terminates at 21 unless you have an agreement that provides otherwise or unless you prove that your child has become emancipated. If you have an agreement that provides for termination of support at 18, go to family court and file a petition to modify and terminate child support.

Child support is payable until age 21 in New York, unless the child is emancipated.
