Legal Question in Family Law in New York
storage of relatives goods
my garage is full of my daughters belongings from a yard sale 3 years ago after repeated times to ask her to clear it out i threatened to send it to the salvation army.
How long do I have to keep the stuff before I can clear out my garage without her permission?
Thank you for your time in this matter

Re: storage of relatives goods
Unless you agreed to hold it and not sell it for her, if you have another yard sale and happen to sell it all, then she only gets what you got for it, possibly minus storage fees. What you don't sell you could then have a persuasive basis for saying it was not worth much and you could probably give it away without worrying about your daughter or a small claims court thinking you acted rashly or unreasonably. Or you could give it all away if you think you could convince a small claims court that 3 years was long enough to store the stuff. Either way, make sure you give notice of your intentions in writing to the owner so you can prove that you did so, for example a certified mail return receipt requested letter or a few witnesses that you delivered the message in writing yourself. These are all cautious suggestions; I have not researched this issue.
