Strange Custody Question

In Feburary of 2007, my wife was bought up on a Child Protective Report for braking my 2 year old daughters arm, she was deemed negligent. To help her make a new start, we moved from NY to Texas. In april, my dad died and we came up for 3 weeks for the funeral. When we were supposed to leave on a Saturday, she told me she had to stay until Wednesday for a Dentist appointment. I had to work so I went home alone on Saturday. On monday, I came down with Pnemonia and had to be hospitalized, she did not show on Wednesday or Thursday and on Friday i checked myself out of the hospital and flew home....she refuses to let me into her parents house to see my kid....i have seen her 2x for 15 minutes. She is visiblly shaken and scratched....there are no custody or seperation agreements......what can i do to protect my child.

If the child has been in Texas for less than 6 months, NY is probably the place for venue. You should see a lawyer right away.

This is not a strange custody question. It sounds as if you need to immediately petition for custody. If the child is in NY then you may file in NY, if she is in Texas then may still be able to file in NY. You need to see a family law attorney ASAP your daughter's health & safety are in jeopardy.
