when to submit application for attorney fees

my stipulation, was dated 5/08/98. two years ago I brought my X back to court for monies not payed to me,pursant to the stiulation.just a mounth ago the judge gave my lawer a memorandum,stating nine out of ten of the issues are in my faver. : but its not over yet:. my lawer doesent think we can go back to get attorney fees from the begining because my previous lawer who started this litergation with me never asked for attorney fees.(different lawers same case)

my stipulation clearly says the defaulting party will pay all attorney fees. thank you

exanple if possible (smith v. smith)

Re: when to submit application for attorney fees

Suggest that your attorney request counsel fees "from the beginning." The issue may settle and the worst the Judge can do is deny the award. So what do you have to lose?
