Subpoena husbands income records including w2''s and 1099's
I believe my ex husband is making more money than he is claiming. I know that he is working fulltime for a company but I also believe he is working as a consultant for the same company and receiving a 1099 at the end of the year. He worked for this company previously as a consultant and I believe he has made some kind of agreement with this company to work as a consultant so his true income would not be exposed and he would not have to pay additional child support. According to our financials, He is required to give me a copy of his w2 form each year but nothing was ever mentioned about a copy of the 1099. i would like to take him back to family court because I beleive his true earnings are more than what was on his w2. Am I able to subpoena these records from his employer so I may use them as proof of his imcome? If not, is there anything I can do to find out his true imcome for the year. Thank you.
