Legal Question in Family Law in New York

Can he sue me for divorce for cruelty so he can buy a house?

My husband cheated on me. I have the video as proof. He has been living at his Mom's house for the past 4 weeks. He served me with divorce papers today. He is claiming I treated him with cruel & inhuman treatment. This is because he couldn't buy a house this week until he served me these papers. What can I do to stall the proceedings, so he loses his house? Can I counter sue since he is the one that cheated? Can I say no to the divorce and get half of his new house? We have no children in common. We were married for 3 years and lived together for 12. We are both on Social Security Disability.

YOu do not have to consent to the divorce. YOu would defend that you did not treat him inhumanly or cruelly. His infidelity doesn't really help you unless you want to move for the divorce.

Get to a lawyer. Make sure if he has money for a house he has money to help support you too.

Good luck.
