Summons for Separation Agreement

If my husband serves me with a summons, am I forced to agree to the separation proposal he has given me or does a judge decide on how things will be divided,etc.

No. This just means that you have to go to court. You can argue your position with the judge when you go to court. If you are not completely destitute, have some assets and have paid any taxes in your life, I would suggest that you retain a competent matrimonial lawyer. Sure, it will cost you money. But in the end you will get more money! Now is not the time to be pro se you have your future to think about.

If you are served with a summons, you have an option. You may either negotiate a settlement with your husband or you may proceed with litigation and ultimately have the court decide on the law.
