Taking child out of state

Can a mother take her child to live in another state if the father is paying regular child support, sees the child regularly and disapproves of the move? The parents are not married but fathers name is on the birth certificate

Re: Taking child out of state

If such a move is not contemplated in the existing agreement or order, or if there is no agreement, the father should petition the court to either stop the relocation or otherwise ensure that his relationship with the child is not disturbed. If it were my case, I would probably try to pre-empt the mother's likely petition for court approval. Please call me at 212-367-9167 as soon as possible if you wish to discuss your particular situation. I do not charge a fee for the initial consultation.

Good luck -
