Legal Question in Family Law in New York

tape recording trial in lieu of stenographer

Can I, at a trial for equitable distribution ask that the entire proceedings be recorded instead of using a court reporter? I have found that some of the transcripts did not contain text that my lawyer and I agree were said during the proceedings.

You can have your attorney ask the Judge about a taped proceeding, but I wouldn't bet on the Judge granting your request.

I do not believe so. Have your attorney ask the Judge about recording in addition to a stenographic transcript. Seeking an additional service might be easier than asking the court to replace it's current recording method. There is likely a court rule on point on how a trial must be recorded. Ask your attorney to research that issue. Family Courts do use recordings. However, there are very stringent standards on the type of equipment that is used. Recently when some Family Courts switched to digital recording, they used two tape recording methods as a backup for some time.
