Legal Question in Family Law in New York
tax return of a child
Well I have not been with the mother of my 17 month old daughter. I have been paying her by check every week of $100. And we have equal custody of her, but she live with her more often. Mainly because she tells me when i am seeing my daughter. Well anyways, she has collected the tax for the past 2 years and never split it with me. What can i do so she needs to split it equal?

Unless your Order of Support indicates that she should split the refund, there is no obligation for her to do so. What the courts usually do, when you ask, is allow you to claim the child on alternate years.
