telephonic hearing

Can a person who lives out of state have telephonic hearings in a visitation case or do I need a legal aid?

Re: telephonic hearing

The Court can hold a hearing using the telephone. However, if at all possible I find it better that the litigant is physically before the Judge. This allows the Court to fully judge the individual, including dress, manner and body language given during an answer.

Should you hire an attorney? That depends on a number of factors like the issue before the Court and your finances.

You can request permission to appear via telephone but, if you are unwilling to travel for a hearing, will you travel to have visitation? I think you lack of appearance will have an impact.

Re: telephonic hearing

This really depends on the sitting judge. However I would suggest if at all possible that a person involved in such hearings appear in person on such a matter of import, if the person cannot be bothered to show, it makes an impression on the Court.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
