terminating parental rights info

I currently live in TN but my divorce and custodity was handled in NY. My questions is this. My two childrens father pays support when he wants and talks to them when convient for him. he hasnt called them in 4 months now. No support in 6 month. I do not care about the support i care about their emotional well being. My current husband has raised them for 3 yrs and taken care of them. He also would like to adopt them. What could my chaces be to get his rights terminated and my husband to adopt them. Their father has even failed court order drug testing but was still granted visitaion of the children. I do know their last visit in july of 06 wasnt very fun for them cause abuse was ivolved but i was told there was nothing i could do about it cause i had no proof other than what they said. Please any info woud be great. Thank you

without the consent of the natural father, your chances are very small. You would need irrefutable evidence that the father was unfit and a continued relationship with him was not in the best interestes of the children. short of that, it is not happening.
