Legal Question in Family Law in New York

transfer of assets before divorce

I am unfortunately in the edge of getting divorced. I found that my sponse has been transfering assets (those we earned after our marriage) under my in-law's name (some transfer was done a year ago). Will those assets still be considered as our marital property, i.e. I will have 50% of that? Or do I not have the right for those assets anymore? Thank you for your advice.

Re: transfer of assets before divorce

Yes, you still have rights to an unauthorized (by you) transfer of marital property. Make sure you have sufficient proof of same.
