What are my rights regarding Custody?

IN a custody case, NY has one standard by which the Courts decide who should gain custody: Best Interest of the Child!
The Court looks at who can better provide for the child's needs.
Your respective "rights" as parents are immaterial - that would only come into the equation after a custody determination has been made for purposes of visitation - and even then it is still always weighed against the best interest of the child.
