Legal Question in Family Law in New York

Uncontested Divorce

Can someone tell me what a ''Note of Issue is''?

Also, ''Certificate of Readiness''?

This is an uncontested divorce, I have no lawyer, and the divorce has been dragged out for 2 years and thousands of dollars. It is very amicable and there is no custody battle. I have given her everything and she is not seeking alimony. Is this normal? I think her lawyer is taking her to the cleaners!!!

Re: Uncontested Divorce

No, that's not normal. Someone must be stalling/dragging it out.

An uncontested divorce, such as you describe, should be ready to be submitted to court in 1-2 wks and then a judgment of divorce granted in about 2 mos.

A Note of Issue is a form that gets filed with final papers. However, a certificate of readiness is only filed if you are going to trial.
