Legal Question in Family Law in New York

if an uncontested divorce papers were provided to respondent. however respondant did not sign the uncontested diovorce papers and the case is appears open and pending even after 10 years. Can the respondant move forward with preparation to proceed in filing with divorce papers.

You'll likely need to buy a new index number. The summons expired 120 days after issuance (10 years ago) and on motion of the defendant any attempt to se this inde number would be dismissed.
