Unjstified allegations of child abuse
We were unjustly accused of child abuse, do we have any legal repercutions against the accusing party and should we get a lawyer. This stemmed from a letter written about a dream that was miscommunicated. The child that wrote the letter was 16 yrs. of age.The accuser has a history of mental instabilty and has threatened this accusation with other people without evidence and not documented. The case worker has been to our home and feels that it will be dismissed. This was from a boy friend, girl friend relationship, the boy friend said that he can analyze dreams and she believed him and it was taken as true.

You may have legal grounds against the accuser, whether it makes financial sense to pursue those grounds is another story. I would need to know more.

This must be very difficult for you. I am a lawyer, and I know that child abuse is a hard stigma. I also know that often the persons accused are not guilty.
The accuser has very likely been abused, but not by you. You must remember that everyone is a victim in a case like this, not just you. You do need some help in this matter, and a lawyer is your best defender. Find one now, don't let this 'take its course'.

You should not take any chances! As with any legal proceedings in court, you should be represented by an attorney so that you do not make foolish mistakes that can come back to haunt you. Generally, going after the person who made the accusation does not pay - you would be spending a great deal of time without seeing a return. But this also depends upon the circumstances. Sometimes it is better to pursue the accuser just to make sure that such accusations are not made again in the future.
