Legal Question in Family Law in New York

Unmarried, Custody Question.

I have a 5 year old son with a woman who recently left me. for all my sons life, we lived in the same house as her (ex-fiance) mother. our son grew up around his grandmother and loves her company and attention.

I work monday-friday typical 9-5. She works sparatic schedules soetimes 7 days a week. She moved into a 1 bedroom apartment by herself, I remained here, with the family where our son is surrounded by everything he ever knew and everyone who loves him.

Now she wants custody.

She had a fight with her mom today and threatened to take our son away for good, leaving me with little vistation and his grandmother with, and I quote ''she'll never se him agian.''

I know that custody often favors the mother, fair and unfair at times. What are my chances of gainig FULL custody of our son?

This is a difficult situation. You have a better chance for 'joint custody' and making the residence the home of you and the grandmother.

It is important to have a lawyer to help you. Legal Aid may be able to assist you.
