unmarried women trying to leave NY

I live in NY and am trying to go back to california with my children... i am not legally married to the childrens father and have been together almost 5 years. I am at the point where the relationship and atmospher is unhealthy for myself and my children... what are my options..

Who has legal custody of the children?

Is the other parent phycially abusive to you or to the children?

If yes, have you called the police?
